Terms and Conditions for FiXPRT

Welcome to FiXPRT ("Platform"), operated and owned by XPRT Platforms (registered address: 26a Brighton Road, Salford, Redhill, United Kingdom). These Terms and Conditions ("Terms," "Agreement") govern your access to and use of the FiXPRT mobile applications (Customer, Provider, Serviceman), customer web application (https://fixprt.com), business/admin portal (https://dash.fixprt.com), and related on-demand service booking technology services offered exclusively for the market in Pakistan.

By creating an account, accessing, or using the Platform, you acknowledge that you have read, understood, and agreed to be legally bound by these Terms. If you do not agree to these Terms, you may not access or use the Platform.

1. Description of Services & Marketplace Architecture

1.1 Marketplace Role: FiXPRT is an on-demand service technology platform operating in Pakistan that connects end-user customers ("Customers") with independent, third-party service providers ("Providers") and their designated technicians ("Servicemen").
1.2 Independent Contractors: Service Providers listed on FiXPRT are independent contractors and not employees, agents, or partners of XPRT Platforms. Each Provider operates their own independent service business.
1.3 Platform Scope: FiXPRT facilitates job booking, matching, coordinate sharing, in-app messaging, invoicing, payment tracking, subscription management, bidding workflows, and dispute mediation.

2. User Account Registration, Authentication & Responsibilities

2.1 Eligibility & Account Creation

• You must be at least 18 years old to register an account on FiXPRT.
• You agree to provide accurate, current, and complete information during registration, including your full legal name, phone number, address, business details (for providers), and any required custom registration fields.

2.2 Authentication & Account Security

• Account authentication, phone number verification, and OTP delivery are managed exclusively through Google Firebase. We do not utilize third-party SMS gateways.
• Users are solely responsible for keeping their account credentials (passwords, OTP codes) confidential.
• You must notify FiXPRT immediately at [email protected] or via WhatsApp at +44 7537 181733 if you suspect any unauthorized access or security breach involving your account.

2.3 User Conduct & Prohibited Activities

Users agree not to:

• Violate any applicable local, national, or international laws or regulations in Pakistan.
• Impersonate any person, business entity, or service provider.
• Engage in abusive, fraudulent, harassing, threatening, or illegal behavior toward other users, service providers, servicemen, or customer support staff.
• Exceed provider cash-in-hand balance limits without settling platform commission dues.
• Interfere with, disrupt, or attempt to compromise the integrity, security, or performance of the FiXPRT Platform or APIs.

3. Data Collection, Location Sharing & Privacy

3.1 Privacy Policy Incorporation: Your privacy is paramount to us. The collection, storage, and processing of your personal data are governed by our dedicated Privacy Policy, which is incorporated into these Terms by reference.
3.2 Location Coordinates & Map Navigation: The FiXPRT application itself does not track user movement in real-time or background. The app only captures and shares user-provided service location coordinates (latitude and longitude) to allow service providers to launch external navigation tools (such as Google Maps) to reach service locations.
3.3 Account Deletion: You retain the right to request full account deletion and personal data removal at any time through the app settings or by contacting [email protected], in compliance with Google Play Store User Data Policies.

4. Bookings, Pricing, Bidding, and Payment Gateway Policy

4.1 Booking Execution & Pricing

• Customers can select services, view estimated pricing, choose service variations, place custom service requests (bidding), and schedule bookings through the Platform.
• Final service prices may vary depending on customized options, extra scope requested on-site, or specific provider bids accepted by the customer before work commences.

4.2 Payment Gateway Policy & Cash-on-Delivery

• PayPal Payment Gateway: The Platform supports digital payments via PayPal.
• Cash-on-Delivery & Local Payments: Service payments are also processed via Cash-on-Delivery (COD) or direct wallet accounting.
• Future Local Payment Integration: Local payment gateway options in Pakistan (such as Easypaisa, JazzCash, or other local providers) are currently under evaluation and will be decided for future platform integration.

4.3 Subscriptions & Pro Membership

FiXPRT offers customer subscription packages ("Pro Membership") providing exclusive platform discounts, zero-commission provider bookings, and priority booking privileges. Subscription terms, fees, and renewal rules are presented clearly upon enrollment.

5. Provider Verification & Badges

5.1 Provider Badges: FiXPRT displays a "Verified Provider Badge" for service providers who complete our background, license, identity, and document verification process.
5.2 Scope of Badge: The Verified Provider Badge indicates administrative compliance with FiXPRT onboarding standards but does not constitute an absolute guarantee of performance quality for every individual service job.

6. Service Limitations, Warranties, and Liability

6.1 Platform Provided "As Is"

The Platform is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied, including fitness for a particular purpose or non-infringement.

6.2 Service Delivery Liability

FiXPRT and XPRT Platforms are not liable for direct, indirect, incidental, special, or consequential damages resulting from physical services performed by third-party providers or servicemen on customer premises.
In any event, the total aggregate liability of XPRT Platforms for any claims arising out of or related to these Terms or the Platform shall not exceed the total commission fee retained by FiXPRT for the specific booking in dispute.

6.3 Dispute Resolution & Mediation

In case of booking disputes, poor workmanship, or cancellation issues, users agree to report the matter to FiXPRT Customer Support at [email protected] or via WhatsApp at +44 7537 181733 within 48 hours of service completion. FiXPRT will act as a reasonable mediator to investigate and resolve disputes fairly.

7. Account Suspension and Termination

7.1 Termination by User: You may stop using the Platform and request account deletion at any time.
7.2 Termination by FiXPRT: We reserve the right to suspend, disable, or terminate your account or access to the Platform immediately, without prior notice, if you breach these Terms, engage in fraudulent behavior, or violate Google Play Store safety policies.

8. Intellectual Property & Brand Ownership

8.1 Trademarks & Copyrights: "FiXPRT", the FiXPRT logos, custom software code, designs, and content are the exclusive intellectual property of XPRT Platforms.
8.2 Restrictions: You may not copy, modify, distribute, reverse engineer, or create derivative works based on any part of the FiXPRT Platform without prior written consent from XPRT Platforms.

9. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the applicable laws of Pakistan, without regard to its conflict of law principles. Any legal suit, action, or proceeding arising out of these Terms shall be instituted exclusively in the competent courts of Pakistan.

10. Modifications to Terms

We reserve the right to amend or update these Terms and Conditions at any time. Updated versions will be published on our Platform with a revised "Last Updated" date. Continued use of the Platform after any modifications signifies your acceptance of the updated Terms.
